"Guest" means a user who requests a booking of a property accommodation via the Site, application or Services, or a user who stays at an accommodation and is not the owner for such accommodation.
"Owner" means a Member who creates a property accommodation listing via the Site for rental to Guests.
"Listing" means a property accommodation that is listed by an Owner as available for rental via the Site.
"Member" means a person who completes the RentalTrips account registration process, including, but not limited to Owners and Guests.
Acceptance of Terms
By accessing our Site and/or using our Service as a potential Owner or Host, You agree to be bound by these Terms, which You acknowledge to have read and understood.
We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms at any time. You must review these Terms on a regular basis to keep yourself informed of any changes.
By using this Site, You agree that the posting of new or revised Terms on the Site shall constitute notice to You of any and all revisions and changes. Continued use of the Service after any such changes or after explicitly accepting the new Terms upon logging into the Site shall constitute Your consent to such changes.
The Platform and Our Role
You acknowledge and accept that We do not consider that we act as a travel agent generally in relation to the provision of our Service or in respect of Your actual rental transactions concluded with Owners as We are not a party to such actual rental transactions and We do not buy-in, re-sell or provide accommodation or other travel services in our own name. However, if, as a matter of law or in the opinion of any tax or other authority in any jurisdiction RentalTrips is or could be considered a travel agent in any jurisdiction in respect of taking part in, or providing a Service consisting of the intermediation in, the provision of accommodation by Owners to Guests pursuant to a booking on our Site, You acknowledge and accept that in those circumstances and for the purposes of these Terms and rental transactions concluded between Guests and Owners, RentalTrips: (i) acts as the Owner's disclosed agent or intermediary in the name of and on behalf of Owners who have listed their properties on our Site, and not in any way in its own name, and such services supplied, acting in that capacity, in taking part in, or consisting of the intermediation in, the provision of an Owner's accommodation listed on our Site and/or in facilitating the conclusion of such rental transactions are supplied to Owners; and (ii) that RentalTrips is not and cannot be an Owner. Any necessary modifications may be made to these Terms and the Terms and Conditions as a consequence of this provision or part thereof applying.
RentalTrips's role is solely to facilitate the availability of the Site and Service for Users and to provide certain services related thereto. We do not purchase, buy-in, sell, own, provide, furnish, rent, sublet, control or manage any accommodation listed on our Site by Owners nor can We contract in our own name for the supply of any holiday rental property listed on the Site nor other properties including, but not limited to, hotel rooms, nor any related transportation or travel services. We are not in any way supplying or able to supply such accommodation or services to Guests. Our Site acts as a platform to allow registered Owners to them offer for rent a specific holiday rental space to Guests. Owners may be either owners of any such holiday rental properties listed on the Site or are persons, for example professional property managers, who are duly authorised to arrange or enter into rental transactions of such properties direct with Guests. We are therefore not a party to the actual rental transaction concluded between Owners and Guests and are not a contracting agent or representative of any Owner. Our responsibility in the provision of the Site and/or Service when such transaction is concluded shall be to forward contact details to both Owners and Guests. Accordingly, the legal contract for the supply of accommodation and rental transactions is between Owners and Guests, being a licence to occupy the Owner's accommodation during the agreed period as detailed in the Owner's booking confirmation but should not be or intended to be a tenancy or lease or grant of exclusive possession of such accommodation. Rental transactions in respect thereof are only binding among Owners and Guests, who are both solely and entirely responsible for their performance and RentalTrips disclaims all liability arising from or in connection with such transactions. If You, as a Guest, enter into a rental transaction with an Owner for the booking of a property listed on the Site, You understand and agree that you will be required to agree terms with the Owner and You agree to accept those terms, and any conditions, rules and restrictions associated with such property as imposed by the Owner.
Guests can offer to make a booking through the Site by following the processes for making a booking request set out on the Site and clicking on the appropriate confirmation button or booking link (via Your Account or email). It is important that Guests check the information entered and correct any errors before making a booking request since once you click on such button or link, input errors cannot be corrected.
If at any time prior to clicking on the appropriate confirmation button or link, you (the Guest) decide that you do not wish to proceed with your booking request, you should close the application window.
Once your booking request has been made, we will then notify the concerned Owner by email and in their Account to accept or reject the booking request. Owners are required to either confirm or reject your booking request within 24 hours of that request, after which the booking request shall automatically be accepted. If the booking request is subsequently accepted by the Owner through our Site, You will receive an automated email confirming the Owner's booking confirmation and the Owner's relevant contact details, and your relevant contact details will also be forwarded to the Owner. The payment process described under Payment below will also apply upon receipt of a booking confirmation.
Once such contact details have been provided, all communication for example, concerning details and information about the booking and rental transaction, including, without limitation, arrival times and handling of keys, should be direct between You and the Owner through our Site as facilitated by our Service where required/applicable.
You will be able to access details of your booking confirmation through Your Account.
Upon receipt of a booking confirmation, Guests enter into a direct contract with the concerned Owner. Owners are not obliged to make any property available until a booking confirmation has been sent by the Owner via the Site to Guests and a Guest is not guaranteed a booking with an Owner until payment has been made by the Guest subject to these Terms. However, upon issuing a booking confirmation, Owners shall be responsible for providing the accommodation referred to in the booking confirmation.
If a Guest requests a booking, they will be responsible and liable to pay the relevant Owner in full the rental rate due for such booking if accepted by the Owner subject, in each case, to these Terms and any other terms and conditions specific to the booking as agreed between a Guest and their Owner. In order to secure collection of such payment, Guests will be asked during the booking process to provide payment card information and billing address. RentalTrips will also obtain a pre-authorisation on your payment card for 30% the total amount of your booking request by way of a deposit to ensure that you have the necessary amount of funds available to cover the transaction. If your booking request is accepted by the Owner for the dates set out in your request, the payment process is described below. If a booking request is refused, expires or is cancelled, any pre-authorisation of your payment card will be released or as applicable, shall expire after a period of up to 30 days unless you contact us to request an earlier release.
As a Guest, if you cancel your booking, the provisions and refund levels described in the cancellation policy below will apply. Please note that no refunds will be provided after the last deadline set out in the cancellation policy selected by the concerned Owner. Furthermore, our Fees (as defined below) are non-refundable.
Any monies collected and received by RentalTrips from Guests for bookings made on the Site shall be held by RentalTrips subject to a conditional obligation to transfer or account for such monies to Owners less our Fees.
Should You decide to book a stay with an Owner and the rental transaction is concluded with such Owner via the Site, You, as a Guest, acknowledge and agree that You shall be required to pay an amount equal to the fees displayed in the Owner's listing on our Site and confirmed in each booking confirmation as agreed with an Owner. The fees displayed in an Owner's listing have two components: (1) the rental rate and any additional charges (included at the Owner's discretion) as solely determined and set by the Owner (and not RentalTrips) in respect of the rental transaction, plus any applicable taxes and VAT, ("Owner Fee") - please see below for information on any additional charges (for example, cleaning fees) that an Owner may have decided to charge and collect separately from the Owner Fee; (2) a service fee, chargeable and disclosed to Owners by RentalTrips based upon a percentage (10%) of the Owner Fee, in consideration of supplying our Service to Owners to the extent that such supplies enable such Owners to connect and conclude transactions with Guests and which shall be deducted from the total Owner Fee by RentalTrips upon transfer of funds to the owner; Our Fees are non-refundable and exclusive of any applicable Taxes and VAT which may be charged in addition thereon, and shall be deducted from the Owner Fee so the total amount payable by the Guest for the stay will be inclusive of our fees.
RentalTrips shall collect a payment from you equal 30% the Owner Fee, by way of a deposit, through the Site immediately when the Owner accepts your booking and a booking confirmation is sent to you by the Owner which, as a Guest, You agree to pay for any booking you have requested that is so accepted by the Owner. As noted above, Owners are required to either accept or reject your booking within 24 hours of your booking request.
For Guests' convenience, the Site can display prices in a choice of currencies. Such converted prices are for information only and Guests payment cards will be debited in the currency of the site which is GBP. RentalTrips disclaims all or any liability in respect of any additional charges that may be charged to a Guest by his or her bank related to Our collection of the payment in the currency set by the site.
RentalTrips shall initiate the payment of the deposit, less our Fees, to the bank account of the Owner in GBP Owner within two UK business days of the booking confirmation, subject to any other arrangement as may be agreed between an Owner and RentalTrips.
As a Guest, You hereby authorise and agree that RentalTrips shall debit (whether directly or indirectly via a third party payment processor, subject to that third party's terms and conditions) Your payment card of the amount of 30% the Owner Fee, by way of a deposit, upon confirmation of Your booking by the Owner. You also agree to pay any other charges agreed with the Owner before the booking confirmation that weren't included in the payment when you arrive at the property or as otherwise agreed with the Owner.
The payment shall be taken by a debit of the Owner Fee plus our Fees from one of the acceptable payment methods listed on the Site, which may include debit and credit card (Eurocard/MasterCard, Visa, American Express or Diners Card) and such payment shall be taken in the currency set by the Owner. Payments by cash or cheque are not accepted, and accordingly RentalTrips cannot be held liable for any loss of cash or cheques. You will also be asked to provide customary billing information such as name, billing address and payment information. As a Guest, You agree to pay all fees and charges contained in the Owner's booking confirmation as accessed through Your Account, irrespective of whether the Service was accessed by You or by a third party using Your Account. It is your responsibility to take all measures that are necessary to ensure that your password remains secret and to prevent the use or misuse of such password by any unauthorised person. You shall notify RentalTrips promptly if you discover or suspect that your password has become accessible to or has been misused by any unauthorised third party, so that we can block your account.
In some circumstances, and in addition to the billing and payment information you provide, we may require you to send us some proof of your identity. This can be requested at the time of booking, during payment processing or at any other time thereafter (but before the check-in date). We reserve the right to cancel your booking if you do not provide such proof of identity when requested by us.
Use of the Service
We take no responsibility for harm which may come to Users as a result of use of Our Service. Users have sole responsibility for all interactions with other Users, whether on Site or face-to-face. We reserve the right to monitor all interactions between Users which are carried out on the Site in order to restrict any behaviour we deem to be inappropriate, or which contravene these Terms. Any action which we deem to be obscene, aggressive, in contravention of these Terms or in any other way inappropriate will result in Users' accounts being restricted or permanently closed without forewarning. We may alter or remove any aspect of our service at any time and at our sole discretion.
In using Our Service you agree to absolve RentalTrips Ltd from responsibility for any harm which may come to you as a result of using the Service. You agree that any compensation which you may seek for harm which comes to you as a result of using the service will not be sought from Us, but rather from the other User or Users. You agree not to seek any legal remedy or damages whether actual, consequential, nominal, punitive, nor otherwise nor impose liability on Us, Our staff, officers, directors, representatives, commercial partners or agents. By using the Site you indemnify and hold harmless RentalTrips Ltd., Our staff, officers, directors, representatives, commercial partners or agents for any negative experience which arises from Your use of the Site.
By using the site, you agree to behave responsibly and not to: i)Violate any law, regulation, contractual obligation or court order, ii) Infringe on the rights of any person, business, group, entity or violate any copyright, patent, trademark, trade secret, or other proprietary right or right of publicity or privacy, iii) Interfere with or damage the Site including viruses, worms, Trojan horses, or other programmes, scripts or software intended to do harm to the Site or other Users, iv) Use our services to distribute any commercial information other than that pertaining to a booking via the Site or post links to third-party websites where accommodation can be searched for, booked or enquired about, v) Post any accommodation which you do not rent, own or have legitimate legal right to rent to other Users on a short-term basis vi) Hold more than one user account, vii) Post false information about You, Your accommodation, Your identity or personality on the Site, viii) Make private arrangements to transact with, meet, stay with or otherwise interact with other Users except via the Site in the manner described, ix) Submit any information which is inaccurate, misleading or false.
By accepting a booking request on the Site at the price specified by You are accepting a legal offer and entering into a legally binding contract with the other User. The price cannot be altered after this offer is accepted.
You are solely responsible for the resolution of disputes with other Users which have arisen as a result of or in connection with User of the Site or Service. We reserve the right to monitor the communication between Users undergoing the process of dispute resolution with impartiality.
By registering with RentalTrips.com you are confirming that you are over the age of 18. Minors may not use this Service.
We have no obligation to post content submitted by You for display on the Site. In addition We may edit or delete any content that you submit without warning and for any reason.
We do not control, and shall have no responsibility for, Third-Party Content, including material that may be unlawful, misleading, incomplete, erroneous, offensive, indecent or otherwise objectionable which You come into contact with as a result of or in connection with use of our Service.
Payment and fees
By using the Service as a guest you agree to pay 30% the amount posted by the host in the form of a deposit via the website. By using the service as a host you agree to pay 10% of the total amount charged to the guest for the stay to RentalTrips Ltd.
Making a booking. As a guest you are required to complete a booking request via the Site. The host will then accept or reject your request. When you make the booking request You will be required to submit either credit card, debit card or Paypal account details and we will pre-authorise your account for 30% the full booking amount in the form of a deposit. If the host accepts your booking request the money will be captured and kept in our bank account. We will transfer money owed to the host within 2 days of the booking confirmation.
The Owner may set additional charges in the form of a deposit or otherwise (for example, cleaning fees, security deposit and late checkout fees) that are due from Guests which are not included or factored in the booking fee and which may be agreed by the Owner by separate arrangement or as expressly stated in the booking summary page and charged directly by an Owner. Payment of such charges (for example upon arrival or check-out) must be made by You direct to the Owner in accordance with the terms You agreed with the Owner. RentalTrips shall not be responsible for administering or accepting Owners requests or claims related to such additional charges or payments and disclaims any liability in this respect.
Our Responsibility and Liability
Our Liability to Guests:
If you have a problem during your stay, please inform the Owner immediately. Since your booking is a contract direct between you and the Owner, the Owner will have sole discretion in deciding how to deal with your complaint. As a Guest, You will also be asked and entitled to leave a review about the listed property on our Site. You will however be solely responsible to resolve any dispute arising out of or related to the stay directly with the Owner. Any refunds beyond the cancellation policies set out below will be at the Owner's discretion.
We only accept responsibility for any injury, illness or death, if caused by our own negligence and liability in respect of statutory rights that you may have against us as a consumer that cannot be excluded or limited by law. Any claims arising out of your stay in an Owner's accommodation must be brought against the Owner.
To the fullest extent permitted by law, we exclude all representations and warranties relating to the rental property that is the subject of your booking with an Owner.
Our Liability to Owners:
We only accept responsibility for any injury, illness or death, if caused by our own negligence and liability in respect of statutory rights that you may have against us and that cannot be excluded or limited by law. Any claims arising out of the Guest staying in your property must be made against the Guest.
Exclusions and limitations
We cannot accept responsibility for any damage, loss, delay, or inconvenience caused by circumstances beyond our reasonable control. Such circumstances include but are not limited to war, threat of war, riots, civil strife, or terrorist activity, industrial disputes, natural or nuclear disasters, fire, airport closures, bad weather conditions, interruption or failure of a utility service or the acts of any local or national government. We reserve the right to cancel any booking affected by such circumstances.
Our aggregate liability to Guests and Owners under or in relation to these Terms and/or any bookings made through the Site is limited to a maximum of three times the value of the booking in question. This limit does not apply to cases involving death or personal injury caused by our negligence.
To the extent permitted by law, We hereby exclude: (i) all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and (ii) any liability for any direct, indirect or consequential loss or damage incurred by any Owner or Guest in connection with any booking including loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; and loss of goodwill, whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability that cannot be excluded or limited under applicable law.
Behaviour of Guests
As a Guest, You accept responsibility for the proper conduct of all members of your party during your stay at an Owner's listed property. We shall be under no obligation whatsoever to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation) that you may incur as a result of your stay being terminated early by the Owner because of your behavior or the behavior of members of your party.
If you cause damage to an Owner's accommodation in which you are staying, you must fully reimburse the Owner concerned for the cost of the damage. You must also indemnify us for the full amount of any claim made against us by the Owner or any third party as a result.
Cancellations by Guests
Guests can cancel their booking at any time, but only in accordance with the RentalTrips cancellation policy. The deposit is non-refundable and the balance of the rental fee is always due at the owner specified period before the arrival date and payable by the guest, direct to the owner. If the cancellation is less than the owner specified period for balance payments prior to the stay and the balance has been paid to the owner, this balance is non-refundable unless the owner is able to re-let the property for the booked period. At the owners discretion, they may refund the guest to the sum receivable from the re-letting after deducting costs and expenses incurred by them.
Provided cancellation is unavoidable, these costs should be recovered by a guests personal travel insurance. We strongly recommend that guests take out insurance to protect against unavoidable cancellation, accident, illness or injury, or breakdown to your vehicle on a self-drive holiday.
As with any type of holiday booking RentalTrips recommend travellers invest in suitable Travel Insurance when they make their booking. This covers unexpected events and gives you piece of mind so you can sit back, relax and enjoy your trip.
RentalTrips recommend Europ Assistance who have partnered with HomeAway.co.uk to provide unique travel insurance tailored to holiday rental cover and from as little as £21 it protects you against non-refundable holiday payments of up to £5,000 should you need to cancel your trip at the last minute.
Europ Assistance also includes lost, damaged or stolen baggage coverage, roadside assistance, medical and legal assistance, and a 24-hour assistance hotline.
Cancellations by RentalTrips
We reserve the right to cancel any booking at any time for security or fraud-protection purposes. In such cases the cancellation policies will not apply, Owners will receive no payment for the cancelled booking and where payment has been taken, the guest will receive a full refund on the card used for the booking.
Cancellations by Owners
Owners should not cancel confirmed bookings but in the unlikely event we are informed by an Owner that they wish to cancel, We will assist the Guest and the concerned Owner in trying to arrange suitable alternative accommodation for the Guest including, for example, by putting the Guest in contact with another Owner and/or by providing details of alternative listings, but in each and every case, We make no undertaking and shall not be under any obligation in such respect. As a Guest, You acknowledge and agree that your payment (or applicable part thereof) shall be applied in relation to any confirmed alternative booking request/accommodation, in accordance with these Terms. In the event no such alternative accommodation is or can be located and/or You do not accept the suitable alternative listed property offered by the Owner or by a new Owner, The guest will receive a full refund from the owner and the owner will forfeit payment for that booking. Continued cancellation of bookings for any reason will result in us reviewing an owners listing suitability for RentalTrips.
Material on our Site is protected by rights of publicity, copyright, trademark, trade secret, and other proprietary rights and intellectual property laws as applicable. You may not sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish or create derivative works from such material except when you have demonstrable consent from Us. "RentalTrips" and "RentalTrips.com" are trademarks of RentalTrips Ltd and are protected law; you agree not to use such marks for any purpose, including but not limited to as metatags on other websites.
You may not systematically retrieve data or other content from our Site to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise. You may not display any portion of our Site in a frame (or any content from our Site through in-line links) without demonstrable consent, which may be requested by contacting us.
Your login details
You will, during the registration process, select a username and password. You are solely responsible for the confidentiality of your username and password. You are responsible for logging off the Site at the end of each session. You agree to notify us immediately of any use of your username and password or any other breach of security which you suspect to be unauthorised.
Right to terminate
We reserve the right to terminate Your access to the Site, deactivate or delete your account and all related information and files associated with your account or restrict or otherwise limit your access to any such files and Services at any time and at our sole and unfettered discretion.
You agree to use our Services in a manner consistent with any and all local, national and international laws and regulations.
If you stay with or host anyone who you feel is acting or has acted inappropriately you must immediately report such person to the appropriate authorities and then to us provided that your report shall not obligate us to take any action beyond that required by law (if any) or cause us to incur any liability to you.
IF YOU USE OUR SERVICES, YOU DO SO AT YOUR SOLE RISK. YOU ACKNOWLEDGE AND AGREE THAT RENTALTRIPS LTD DOES NOT CHECK ANY GUEST, HOST, OR OTHER USER'S BACKGROUND OR RECORD. USE COMMON SENSE. BE AWARE AND BE SAFE. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND WITHOUT ANY WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM, AND YOU WAIVE, ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We shall not be liable for damages or compensation of any kind even if informed of the possibility of such damages which arise from the use of our Service including but not limited to: damage to You or Your property, loss of earnings, loss or disclosure of your information or submitted content, harm cause to You as a result of using the service, or by third parties who you have come into contact with as a result of using our service.
We are not liable for any failure to deliver the Service as described when the failure is due to factors beyond our control including, but not limited to, acts of nature and power, or lack of internet or email access.
In no event will our liability to you or a third party as a result of or in connection with use of the Site exceed 100 GBP.
